Section 5(a)(1) of the Occupational Safety and Health Act of 1970: As the
creating employer
you did not furnish employment and a place of employment which were free
from recognized
hazards that were causing or likely to cause death or serious physical
harm to the employees
of contractors in that employees were exposed to:
(a) On or about December 18, 1998 and at times prior thereto employees of
the general
contractor, Oswood Construction, were exposed to the hazard of being
struck by falling
construction materials while working on the remodeling construction site
at the M.S.U.
College of Technology, Great Falls, Montana due to incomplete design plan
specifications
and inadequate oversight of the construction methods and materials used as
specified in the
plans.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THIS HAZARD IS:
1. Ensure that all critical design information including, but not limited
to, the shape
(minimum flange width and lip) of the studs and joists and their minimum
yield strength.
2. Ensure that the contractor follows the plans and submits material lists
and
specifications according to recognized practices and as specified in the
plans or contract.
