Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
(a) The hazard of being struck by the log carriage while hooking and
unhooking choker
cables from the mainline of the log carriage on or about October 5, 1998
and at times prior
thereto at the Johnson Shorts Timber Sale, Johnson Draw, Libby, Montana.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to provide a means for employees that would require them not to
work underneath
the suspended log carriage while hooking and unhooking choker cables.
