Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being exposed to a fall while standing on the forks being raised approximately 17 feet above ground level by a Sky Trak rough terrain forklift at the construction site at the corner of Hawthorne Lane and Mary Street in Billings, Montana on or about September 24, 1998 and at times prior thereto. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to provide equipment designed for personnel lifting, e.g. scissor lift or articulated boom lift or follow the requirements of ASME B56.6-1992 and ASME B56.6a-1994 Addenda when using the rough terrain forklift.
