Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being exposed to a fall due to equipment tip over while working on a metal platform raised approximately 11 feet and 13 feet above the ground level by a John Deere JD 480-A forklift at the construction site at the East Helena Middle School. (1) The platform for lifting personnel was not secured to the forklift. (2) The platform for lifting personnel extended beyond the tires 20 inches on each side. (3) Seat belts must be worn when operating the forklift. (4) There was no capacity plate on the forklift. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to provide equipment designed for personnel lifting, e.g. scissor lift or articulated boom lift or follow the requirements of ASME B56.6-1992 and ASME B56.6a-1994 Addenda when using the forklift. __ Abatement certification or documentation is NOT required for this item.
