Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Section 35(a)(1) of the Virgin Islands Act of 1973: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about January 8, 1999, CSHO observed at the entrance of the Day Adult Education Complex a four inch drop at the entrance of the ladies restroom. Employer failed to provide a ramp and handrail system leading into the restroom for disable persons. Lack of ramp and handrail made it very difficult or impossible for disabled individuals to utilize this facility. Disabled persons utilizing this facility would have great difficulty accessing the restroom, and could fall and hurt themselves as a result of trying to access this lavatory or restroom. CSHO suggested that a ramp leading into the restroom and handrail system be installed by the toilet facility to accommodate said person or persons utilizing this restroom. Employer's representative stated and agreed that a ramp and handrail system was needed in this situation. Employer's representative disregarded the ADA ACT Public Law 101.336 Section 227 (Alteration of existing facilities 42 USC 12147). HAZARD: FALL
