employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
a.Employees working in the marine terminal yard were exposed to being
injured
by the defective #38 Komatsu front endloader. The front endloader had
various deficiencies such
as but not limited to:  broken front and back windshield; bent steps used
to get into the machine;
missing back-up alarm.
One feasible means of correcting these hazards are to have operators to
perform inspection
checklists daily and have maintenance performed on noted items.
