Section 5(a)(1) of the Occupational Safety and Health of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from moving construction equipment: a) Exton Crossing Development - On November 12, 1998, employees of Rental Properties, Inc. were transported around the jobsite while sitting in the bucket of the Case 580E front end loader which resulted in the crushing death of one employee. ABATEMENT NOTE - Among other methods, one feasible method to correct this hazard is to enforce a work rule that prohibits riders on construction equipment, such as is discussed in the owners manual provided with the equipment.
