Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling approximately 5 feet 6 inches from a platform supported by the forks of a Maniscopic Manitou Forklift truck: Construction site: Route 303 & Route 59 West Nyack NY On or about 2/26/97, a) An unguarded platform supported by the forks of a Maniscopic Manitou forklift truck was used to raise and lower employees stripping forms from a concrete wall. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To use a safety platform secured to the lifting carriage and/or forks as stipulated by ANSI B56.1-1975, sections 427 and 513A, American National Standard for Power Industrial Trucks (lowlift and highlift trucks).
