Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of being struck by the collapsing of a wall during installation of steel lintels. Location: 7 Wells/62 Warburton Avenues, Yonkers N.Y. ON OR ABOUT: 04/23/97 date of the collapse a) The employer did not follow the original documents/instructions contained in the Engineer of Record drawings, due to changed site conditions. The employer did not request the General Contractor and /or the structural engineer for new details. Note: No abatement certification required. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Consult the Engineer of Record or the General Contractor for instructions/documentation for all changes to the original drawings, documents or instructions, before proceeding to install steel lintels.
