Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: the collapsing of a steel I-Beam structure that was
"Rough Hung", I-Beam was
not secured by its permanent means, which was to bolt the I-Beam to column
J-7.
Location: Tower 2 Parking Lot Lower level; J-7, I-Beam # W1409B1,
Palisades Center Rt 59
& 303 Nyack NY.
On or About: 12/18/97
& The employer did not inform all necessary contractors that the I-Beam #
W1409B1 at J-7 was
in a "Rough Hung" condition and the steel 18 inches X 18 inches plate was
not bolted to the
column. Therefore the floor deck at J-7 and J-6 was not ready to receive
the concrete pour.
AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS:
A) The employer, shall verify by means of a written inspection record,
that all items relating
to the steel erection and steel connections have been accomplished
according to the Framing
Plans and Foundation Plans.
B) The employer, must inform all necessary contractors in writing of any
items found from the
inspection not to be accomplished as described in the Foundation Plans and
Framing Plans prior
to any concrete pour.
NOTE: Because abatement of this violation is already documented in the
inspection case file,
the employer need not submit certification or documentation of abatement
of this violation as
normally required by 29 CFR 1903.19.
