Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were expose to the hazard of being struck and/or crushed by a
moving Pusher
arm:
Location: The Dress Barn, Warehouse
On or About: 02/23/99
a) The employer allowed employees to operate a Padlocker Case Form machine
# 209, with
the interlock switch removed from the sliding door as it was designed to
prevent entry into
the moving machine parts. The removed interlock switch connection was then
placed with its
mate, bypassing the safety interlock system and making it non-functional.
The employees
then operated the Case Form machine while the employees arm was placed
inside the
operating area. The Pusher Arm of the Case Form machine then trapped the
employee's arm
in the machine, between the end of the machine and the Pusher Arm.
AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD IS:
1) All interlocking doors on the Padlocker Case Form machine # 209 shall
be in the closed
position before the machine is operated.
2) The Padlocker Case Form machine # 209 interlocks shall never be removed
from
their
locations at any time.
3) Prior to use of the Padlocker Case machine # 209, and any other similar
equipment,
interlocks switches shall be inspected and tested to ensure they are
functioning properly.
NOTE: The employer is required to submit abatement certification for this
item in
accordance with 29 CFR 1903.19.ce
