Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employees a place of employment which was free from recognized hazards that are likely to cause death or serious physical harm to employee in that, employees were exposed to caught-in-between hazards which may result in serious injury or death. (a) Loading Dock Area - Paragraph 5.3.19 of American National Standards Institute (ANSI) B 56.1c-1991 (Safety Standard for Low Lift and High Lift Trucks), employees were not required to use seat belts/restraints devices to reduce entrapment of the operator's head and/or torso between the fork lift truck and the ground in the event of a tipover.
