Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees
exposed to the hazard of
being infected with Mycobacterium tuberculosis through unprotected contact
with patients who
was/were infectious or suspected to be infectious:
a)At the St. Paul Health Center: where employees were potentially exposed
to active TB
the employer did not develop a written TB exposure control program. The
clinic had
three or four active TB cases in the past two year, the most recent case
occurred during
the later part of 2001, potentially exposing employees to the hazard of
exposure to
infectious TB disease.
NOTE:  Feasible and useful abatement methods for reducing this hazard, as
recommend by the
CDC, include, but are not limited to: developing a written TB Exposure
Control Program using
the CDC guidelines for preventing the transmission of Mycobacterium
Tuberculosis in Health
