Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing and struck-by hazards.
(a)Great Northwest, Inc.: An employee operating a Caterpillar IT28G

was not wearing the provided seatbelt restraint device when he rolled the
vehicle down
the side of an asphalt pile. Among other methods, one feasible and
acceptable method
to correct the hazard is to mandate and continuously enforce onsite usage
of seatbelt
restraints through retraining and clarity of employer's work rules.er's
