Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards: (a)Chugach McKinley Incorporated (Integrated Support Command Kodiak Site 6B Soil Burner Pad): The site controlling employer did not correct the hazard which exposed a Brechan Enterprises Inc. (subcontractor) employee to a caught-in hazard while he operated a Caterpillar Roller Tractor (Model D4C, Series III, Pin 7SL00283) without the use of the installed restraint device. Among other methods, one feasible and acceptable method to correct the hazard is to mandate and continuously enforce onsite usage of seatbelt restraints through retraining and clarity of employer's work rules.er's
