Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being sprayed with concentrated sulfuric acid when the adapter used failed during transloading operations. a) Sulfuric acid transloading operation, on or about 01/03/01 - the design, construction, and installation of the connection adapter (Christmas Tree) used for the transfer operation was not suitable for the service in that: 1. The use of polypropylene/polyvinyl chloride (thermoplastic) material is not recommended as piping material for this service. 2. The adapter was not protected or safeguarded from excessive temperature, shock, vibration, pulsation, and mechanical abuse. 3. There was no support for the piping and any equipment, such as, transfer hoses, which transmit excessive loads to the piping. 4. The use of threaded joints in nonmetallic piping as well as nonmetallic valves was not prohibited. Among other methods, one feasible and acceptable abatement method to correct this hazard is to design, construct, and install the unloading connection adapter (Christmas Tree) in accordance with the American National Standard on Process Piping ASME B31.3-1996. For additional assistance, please refer to the National Association of Corrosion Engineers (NACE) Standard Recommended Practice RP0391, Materials for the Handling and Storage of Concentrated (90 to 100) Sulfuric Acid at Ambient Temperatures.
