Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)Captain's Barge - On or about 11/29/07, hooks on hoist chains were missing safety latches or had damaged safety latches. Among other methods, one feasible and acceptable method to correct this hazard would be the installation of a safety latch on the hook as recognized in 1917.45(e)(2) which states "Crane hooks shall be latched or otherwise secured to prevent accidental load disengagement." Also to comply with the requirements of the American Society of Mechanical Engineers Standard ASME B30.10-1993, Hooks, Section 10-1.1.2(b).
