Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or crushing hazards: a)203 Bastogne Ave, Ft. Campbell, KY - On or about 06/26/08, employees were exposed to crushing hazards while operating a rough terrain forklift without wearing a seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to seat belts when operating the forklift as referenced in the Owner's manual "The material handler operator must be seated in the cab with seat belt properly fastened at all times when operating the Material Handler" and as referenced in ANSI B56 1-1993, Section 5.3.19: An active operator protection device or system, when provided, shall be used.
