Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a)Locomotive Repair Shop - On or about 03/25/09, employees were exposed to crushing hazards while operating forklifts without wearing seat belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to wear seat belts when operating forklifts as referenced in ANSI B56 1- 1993, Section 5.3.19: An active operator protection device or system, when provided, shall be used.
