Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: a)Dock Leveler 14 - On or about 3/30/10, employees were exposed to struck-by and crushing hazards when the dock levelers were not thoroughly inspected for structural defects. The service leg broke due to metal fatigue causing the leveler to fall onto the employee. b)Dock Leveler 15 - On or about 03/31/10, employees were exposed to struck-by and crushing hazards when the dock levelers were not thoroughly inspected for structural defects. The service leg cup was missing from the lip of the leveler. Among other methods, one feasible and acceptable method to correct this hazard would be to follow the Manufacturer's recommendation for periodic maintenance and follow ANSI standard MH30.1-2000, For the Safety, Performance and Testing of Dock Leveling Devices, Section 4.4.4, manufacturer's recommended periodic maintenance and inspection procedures.
