General-duty citation text

29 CFR 1960.8(a): The agency did not furnish to each employee employment
which was free
from recognized hazards that are causing or are likely to cause death or
serious physical harm:
a)431 Battlefield Memorial Hwy - On or about June 21,2011, employees were
exposed to
crushing hazards while operating riding lawn mowers without using the
roll-over
protection system (ROPS).
b)431 Battlefield Memorial Hwy - On or about June 21, 2011, employees were
exposed
to crushing hazards while operating riding lawn mowers without wearing a
seat belt.
c) 431 Battlefield Memorial Hwy - On or about June 22, 2011, employees
were exposed
to crushing hazards while operating tractor with batwings without using
the roll-over
protection system (ROPS).
Among other methods, one feasible and acceptable abatement method to
correct
this hazard
would be to follow the manufacturer's operator's manual, which states:
"Always keep the roll
bar in the raised and locked position and use the seat belt", "keep the
ROPS in the fully
extended and locked position" and follow warning labels on the machinery
which states: "Lower
the roll bar only when absolutely necessary. Raise the roll bar as soon as
clearance permits."
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRETIVE ACTION WORKSHEET).
