Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a drowning hazard:
(a)On November 28, 2006, employees were exposed to a drowning hazard while
operating a skiff (Jon boat) between mile markers 403.6 and 404.0 on the
Mississippi River.  The air horn provided as part of the skiff's emergency
equipment was encased in its original anti-theft packaging and not
available for
signaling use in the event of an emergency.
(b)On November 28, 2006, employees were exposed to a drowning hazard while
operating a skiff (Jon boat) between mile markers 403.6 and 404.0 on the
Mississippi River with a 75 horsepower outboard motor which could overpower
the skiff.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
(1)Provide an air horn in the skiff which has been removed from all
security
packaging so that it is immediately accessible and available for emergency
use;
and
(2)Provide an outboard motor for the skiff of appropriate horsepower and
which is
not overpowered for the skiff and its intended use.
Abatement verification is required for this violation.  The abatement
certification sheet is
enclosed with the citation(s).
