Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) 8761 Alameda, El Paso, Texas. Two (2) employees of Two States Electric were exposed to a danger of falling approximately 20 feet when they had climbed the forks of a Caterpillar 936E front end loader for the purpose of working from inside of the loaders bucket. One of the employees had erected a 6 foot ladder inside of the loaders bucket in order to reach the electrical components of the 20 foot sign. The loader was positioned by an employee of El Paso Truck and Machinery, then he left the loader unattended when the Two States Electric employees were exposed to the hazards of falling.
