Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the conditions listed below:
Pinnacle Logistics, 9820 Railroad Drive, El Paso, Texas, for the period of
time up to and
including 12/14/99, at approximately 1000 hrs.  Employees operating
forklifts were observed
drivng forklifts on the loading dock area without wearing the safety belts
provided.  In addition,
the employer, Pinnacle Logistics, failed to provide seat belts on some of
their sit-down model
forklifts.  This condition exposed employees to the hazards of being
struck/crushed by the lift
trucks overhead guard in the event of an accidental truck tip-over.
A feasible and acceptable abatement method to correct his hazard would be:
Ensure that forklift
operators wear supplied safety belts anytime they operate a sit-down model
lift
truck, and ensure
that all sit-down model lift trucks are equipped with a seat belt.
