Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: (a) Southwestern Security Service, Inc. located at 8915 Montana street, in El Paso, Texas at the Immigration and Naturalization Service Detention Center: The employees of Southwestern Security Services were exposed to various types of injuries by the detainee's as the security guards were unable to communicate with other guards due to the fact, that their two way radios were non operable. In some cases the two way radios were not functioning at all, or the life of the two way radio batteries were dead and of no use to the guards. These conditions could have resulted in injuries and possible death to the security guards. The contract between INS and Southwestern Security Service calls for a sufficient number of two way radio units to equip each officer, as well as an equivalent number of batteries and battery chargers. At this detention center there are approximately a total number of 218 full and temporary security guards on the payroll of Southwestern Security Service, Inc. The inventory of available working radios was 143 radios. This did not meet the contract agreement with INS, and left guards without two way communication. The Southwestern Security Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard( 5(a)(1)) which was contained in osha inspection number 301570297 citation number 01, item 001, issued on March 9, 2001 with respect to a workplace located at 8915 Montana Street, El Paso, Texas 79906.
