Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: (a) Prime Irrigation and Landscape, located at the northeast corner of Washington and Paisano Streets, in El Paso, Texas. An employee of Prime Irrigation and Landscape was exposed to the hazard of falling approximately 12 feet to the ground while working inside an elevated bucket of a backhoe. The exposed employee working inside the elevated bucket was in the process of felling a tree with a chain saw without any type of fall protection.ly
