Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the conditions listed below:
a)Valeo Wiper Systems worksite located at 5A Zane Grey, in El Paso, Texas,
for the
period of time up to and including  8/6/03 at approximately 0830 hrs.  A
forklift operator was
observed operating the forklift in the loading dock area while not wearing
a seat belt.  The
employers forklifts did not have seat belts installed for employee use and
protection.
This condition exposed employees operating the forklifts to the hazards of
being struck / crushed
by the forklifts overhead guard should the forklift be accidentally tipped
over and result in the
operator being thrown out of the operator seat.
