Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: Loading dock; On or before November 26, 2003, the employer failed to ensure that the Clark forklift was fitted with a seat belt as required by ANSI B56.1-2000. Employee(s) were exposed to the hazard of being struck or crushed by the forklift overhead guard in the event of a tip over. Among other methods, one feasible and acceptable abatement method to correct this hazard is to retro-fit the forklift with a seat belt.
