Section 5(a)(1) of the Occuaptional Safety and Health Act of 1970: The employer did not furnish employment and a place of employment whihc was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that maintenance personnel were exposed to the hazards of being struck by the pie carts and All Purpose Containers (APC's) while performing maintenance and/or repair on the back side of the DBCS mail sorting machines, thereby exposing them to the potential of being caught in moving parts. AVD: Among other methods, feasible and acceptable means of abatement to correct this hazard include: (1) to use barrier guard that would be approximately 24-26 inches away from the back of the machine, (2) movable anchored guardrail system, (3) chain or a rope to block that area; and follow the nationally established maintenance procedures.
