Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the rollover and/or collision of powered industrial trucks: In the following instances seat belts were not being worn by employees operating forklifts. Seat belts are a component of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a rollover or collision: a)Warehouse - Crown #4 was not equipped with a seat belt b)Warehouse - Crown #1 was not equipped with a seat belt c)Warehouse - Crown #2 was not equipped with a seat belt
