Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the rollover and/or collision of powered industrial trucks: At the Establishment - On or about 12/8/99 a seatbelt was not worn by employees operating a forklift #112 Optimum 50 Nissan forklift. Seat belts are a component of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a roll-over or collision.
