Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the rollover and/or collision of powered industrial trucks: In the following instances employees operating powered industrial trucks were not wearing their seat belt. a)Yard Area - Employee operating a 928F Cat powered industrial trucks was not wearing a seat belt. b)At the Facility - Employee operating a 930 Caterpillar powered industrial truck was not wearing a seat belt.
