Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an unstable mobile steel frame being used to lift material such as the "Big Ben": Among other methods, one feasible and acceptable abatement method is to provide a lifting frame designed for the purpose for which it is intended to be used. At the Worksite - A mobil steel frame used to support or lift heavy equipment such as the "Big Ben" failed to provide adequate support to prevent unintentional trippage and displacement.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to using equipment such as the mobile steel frame without being adequately trained because there is no standard operating procedures in place: Among other methods, one feasible and acceptable abatement method is to provide adequate training and develop with an engineer the operational procedures that need to be in place before utilizing this piece of equipment. Also, alternative methods need to be developed if the piece of equipment being lifted does not properly release. At the Worksite - There were no procedures in place for operating the mobile steel lift, the capabilities of the lift or alternative procedures for when the equipment being lifted or disengaged does not properly release.
