Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with not wearing seat belts in powered industrial vehicles. Among other methods, one feasible and acceptable abatement method to correct this hazard is to wear seat belts while operating powered industrial vehicles. Plant wide - The use of seat belts while operating powered industrial vehicles is not enforced. The vehicles are operated inside as well as outside, over terrain which is uneven and slippery. Your company was previously cited for a violation of this Occupational Safety and Health Standard which was contained in OSHA inspection No.301671202, Citation #1, item 1, issued on 4/7/03.
