Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Employees exposed to falls due did not having a safe access method to the "nichos". At National Lumber & Hardware, located on Road #3 Principal Ave. Urb. Baralt, Fajardo: Where the employees were doing their tasks, the employer did not provide a fall protection equipment or safe procedures or methods. The employees to put or found the merchandise in the "nichos" they up and down doing stairs with the same merchandise of the "nichos". Aomg other methods, one feasible and acceptable method to correct this hazard is provide to the employees a fall protection equipment. Empleados expuestos a caidas por no tener un metodo de acceso seguro a los "nichos". En National Lumber & Hardware, localizado en la Carr. #3 Km 44.9 Ave. Principal Urb. Baralt, Fajardo: Donde los empleados realizaban sus tareas, el patrono no proveyo un equipo de proteccion contra caidas o procedimientos o metodos seguros. Los empleados para colocar o buscar mercancia en los "nichos" ellos suben y bajan haciendo escalones con la misma mercancia de los "nichos". Entre otros metodos, un metodo apropiado y aceptable para corregir este riesgo es proveerle a los empleados un equipo de proteccion contra caidas.
