Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or phisical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Employees were exposed to heat exhaustion and heat stroke due to the high
temperatures
meanwhile they were doing their tasks. At the El Conquistador Partnership
L.P. D/B/A
Wyndham El Conquistador & Golden Door SPA, at the Casitas Kitchen area,
where
the
employees were doing their tasks, it was observed the following:
a.) At the "hot line" area, an employee were working at 43.0 C (109.4 F).
The
sampling was performed for 93 minutes 30 seconds on December 3, 2004. The
equipment used to these temperature survey was the Heat Stress Meter (Bar
Code
S12007, MFR QUE, Model No. Questemp, Serial No. JU5100024).
Among another methods, one feasible and acceptable abatement method is
provide a
ventilation system that can adjust to the measures, conditions and
necessities of the
workplace.
Los empleados estuvieron expuestos a agotamiento por calor y a insolacion
debido a las
altas temperaturas registradas mientras realiazaban sus tareas. En El
Conquistador
Partnership L.P. D/B/A Wyndham El Conquistador Resort & Golden Door SPA,
en el
area de Casitas Kitchen, donde los empleados estaban realizando sus tareas
se observo
lo siguiente:
a.) En el area de la linea caliente, un empleado estuvo trabajando a 43.0
C (109.4
F). El estudio se realizo durante un periodo de tiempo de 93 minutos, 30
segundos el dia 3 de diciembre de 2004. El equipo utilizado en este
muestreo de
temperatura fue el Heat Stress Meter (Codigo de barra S12007, Mfr. QUE,
Modelo No. Questemp, No. de Serie JU5100024).
Entre otros metodos de correccion, uno factible y aceptable, es proveer un
sistema de
ventilacion que se ajuste a las medidas, condiciones y necesidades de ese
lugar de
trabajo.
