Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Run-a-Round track, north side of Bay #4, signal person, radio contact, stop signs, or other means of protection was not provided for vehicles and walking and working employees while crossing an active railroad track on or about July 31, 1997, resulting in the crushing death of an employee of another contractor. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to adopt the General Code of Operating Rules Concerning railroad operation of Union Pacific Railroad or the standard and procedure outlined in 49 CFR Chapter II, Part 220 Subpart B.
