Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the jobsite, an unauthorized employee was riding outside a John Deere backhoe. Means of feasible abatement include, but may not be limited to: 1) Development of a company policy that will not allow employees to ride on the sides of heavy equipment. 2) If employees have to work in an area that requires transportation, that the company provide a vehicle that provides a safe place for employees to ride.
