KRS 338.031(1)(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.On or before July 10, 1997, the employer had not assessed an ash pond for material stability exposing employees of Trans-Ash who were operating heavy equipment on a mound of unconsolidated ash while working at the East Kentucky Power Cooperative-Spurlock Station ash pond, thus resulting in the fatality of one (1) operator.
