SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended, as follows: A. Employer knew or should have known that operating a Lull Highlander 844 forklift with an obstructed view to the rear with an inoperable backup alarm and no observer used when it is operated in reverse gear near buildings 7 and 8 exposed employees of various trades to the hazard of being backed over. A feasible and useful method, among others to correct this hazard is to install and operable backup alarm on the forklift. B. Employer knew or should have known that operating a Lull Highlander forklift with an obstructed view to the rear with an inoperable backup alarm and no observer used when operated in reverse gear near building 5 exposed employees of various trades to the hazard of being backed over. A feasible and useful method among others to correct this hazard is to install an operable backup alarm on the forklift.
