North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition(s) of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to infrared and ultraviolet radiation sources: Re: American National Standards Institute, ANSI Z136.1/ "Safe Use of Lasers" a)Plant, Amada Pulsar II carbon dioxide metal cutting laser (class IV/ 1.5kw watts/ 10.6 micrometers) - an administrative laser safety program was not implemented and did not effectively address: 1) employee training(sec. 5.1, 5.2, 5.3) 2) annual medical examinations(sec. 6.1, 6.2, 6.3, 6.4) 3) compliance with manufacturer's specified nominal hazard zone (NHZ) or restricted access area. Among other methods, one feasible and acceptable method to correct this hazard would be the implementation of an employee laser safety program in accordance with ANSI Z136.1 (1983 or most current) including, but not limited to sections 5 & 6.
