North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  condition of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to wood dust in a wood
working facility:
a)site - interior walls attracting a build up of wood flour
and wood dust.  Walls made of wood, reverse wall boards
with 1/2 inch ledges facing upwards and plastic vapor
barrier on ceiling and walls attracting wood dust
(reference:  NFPA 664-1988 2-5.1).
b)site - two inches by 4 inches boards on surfaces not
readily accessible in ceiling joists were exposed to
collecting wood dust up to 2 inches high were not
inclined at an angle of not less than 45 degrees from the
horizontal to minimize dust accumulation (reference:
NFPA 664-1988 2-5.2).
d)site - woodworking jointers, saws and sanders operated in
rooms areas where a dust explosion hazard existed in
rooms, buildings, or other enclosures the areas were not
provided with explosion venting (reference: NFPA 664-1988
3.1.2).
e)site - provisions were not made for systematic, through
cleaning of the entire plant at frequent intervals to
remove the accumulations of finely divided wood dust that
might be dislodged and lead to an explosion (reference
NFPA 664-1988 4.1.1).
f)site - powered cleaning apparatus (leaf blower) not
approved for Class II Division 1 Group G locations were
used in dusty areas (reference: NFPA 664-1988 4-1.3).
g) site - compressed air or other similar means to remove
dust accumulation from areas not readily accessible for
cleaning was done in an environment with over 1/8 of inch
of wood dust was in the area and a myriad of spark
producing electrical equipment was used during blow down
(reference: NFPA 664-1988 4-1.4).
h)site - static electricity was not prevented from
accumulating on machines and equipment subject to static
electricity build up by permanent grounding  and bonding
wires and from moving belts by grounded metal combs or
other effective means (reference: NFPA 664-1988 6-2.1)
i)site - smoking was allowed throughout the plant
(reference NFPA 664-1988 6-3).
j)site - homemade 55 gallon drum heater with chimney with
90 degree turns through second floor with wood flour on
all components was located in area where employees are
exposed to fire and or wood dust explosive hazard and in
traffic way to front exit egress path (NFPA 86-1988 2-
1.4.2).
k)site - no maintenance program for all air moving
equipment requiring a periodic inspection over the entire
length, from entrance to exhaust hood for duct system to
point of discharge was implemented (reference: NFPA 91-
1988 2-3.1.1).
l)site - before new equipment was installed or existing
equipment remodeled, complete working plans and
specifications were not submitted for approval to the
authority having jurisdiction reference: NFPA 91-1988  2-
4.1).
One feasible method of abatement is to bring the site up to the
1997 National Fire Protection Association Code standards.
