North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees condition(s) of employment and a place of
employment which was free from recognized hazards that were causing
or likely to cause death or serious physical harm to employees in
that employees were exposed to the hazard of being struck by motor
vehicles:
a) Town of Chapel Hill, street intersection & Ephesus Church
Rd. and Tinkerbell Rd. - Employees working on shoulder of
eastbound lane of Ephesus Ch. Rd. were exposed to
vehicular traffic where advance informational warning
signs were not deployed in advance (500, 1000, 1500 ft.)
of the work area in accordance with the Manual on Uniform
Traffic Control Devices (ANSI D6.1-1971).
In the Alternative
29 CFR 1926.200(g)(2):  Traffic control signs and devices used for
the protection of workmen shall conform to American National
Standards Institute D6.1 1971(or most current)/ Manual on Uniform
Traffic Control Devices for Streets and Highways:
One feasible method to abate this condition would be to
obtain appropriate signs and equipment, train employees
and monitor compliance.
