North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to freezing temperatures to 20 degrees fahrenheit with no means of egress. a)The freezer door, brand name Enviro manufactured by ASI Industries of Milwaukee, to the freezer on the inside dock in the shipping/receiving department of the BBQ House had an inoperable emergency door release latch that prevented any employee trapped inside the freezer from escaping. Among other methods, one feasible and acceptable method to correct this hazard would be to repair the emergency latch to operate normally, as required by industry standards of freezer and refrigerator door manufacturers.
