North Carolina General Statue 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees condition(s) of employment and a place of
employment which was free from recognized hazards that were causing
or likely to cause death or serious physical harm to employees in
that employees were exposed to the hazard of being struck by motor
vehicles:
a) Site, Ben Franklin Blvd.-  Employees operating portable
gasoline powered grass trimmers, blowers and riding
lawnmower in the public roadway were exposed to vehicular
traffic, and where advance informational warning signs
were not deployed in advance (500, 1000, 1500 ft.) of the
work area in accordance with the Manual on Uniform
Traffic Control Devices (ANSI D6.1-1971).
In the Alternative
29 CFR 1926.200(g)(2):  Traffic control signs and devices used for
the protection of workmen shall conform to American National
Standards Institute D6.1 1971(or most current)/ Manual on Uniform
Traffic Control Devices for Streets and Highways:
One feasible method to abate this condition would be to
obtain appropriate signs and equipment, train employees
and monitor compliance.

mower(s) in the public roadway were not provided or wore
brightly colored / relectorized work vests, hearing and
eye/ face personal protective equipment.
In the Alternative
CFR 1910.132(d)(1):  The employer did not assess the workplace
to determine if hazards were present or were likely to be
present, which required the use of personal protection,
including, but not limited to brightly colored red or orange
warning vests or garments.
One feasible method to abate this condition would be to
obtain appropriate vests, garments and monitor employee
compliance.

consisting of a fluorescent yellow-orange triangle with dark
red reflectorized border was not displayed on such vehicles or
equipment operated in the roadway:
One feasible method to abate this condition would be to
obtain sign(s) and install on equipment.

in the public roadway were Not trained in the
identification and correction of hazardous conditions
associated with vehicular traffic.
In the Alternative
29 CFR 1926.21(b)(1):  The employer failed to instruct each
employee in the recognition and avoidance of unsafe conditions
and the OSHA requirements applicable to the work environment
to eliminate hazards or exposures to illness.
One feasible method to abate this condition would be to
conduct training sessions regarding applicable OSHA
requirements.
