40.1-51.1.(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of equipment roll-over while attempting to unload, move and put in place the 3-ton Hollingsworth draw frame. The employer had not trained the 4 affected employees in the specifics of the installation procedures for the Hollingsworth draw frames; the employees moving these machines had not been involved in the previous installation of a similar machine earlier in the year; the employees had encountered difficulties in unloading the two draw frames from the delivery truck and the employer allowed the operation to continue without taking additional precautions; and the employer had pre-arranged in the purchase contract for a factory representative from Hollingsworth to move, prepare, install and conduct training on the two draw frames, the same procedure that had been used successfully in the installation of the previously purchased draw frame. "One feasible and acceptable abatement method, among others, to correct this hazard is to follow the manufacturer's procedures for reporting equipment malfunction or failure to the factory, and ensuring that the manufacturer's representative conducts all contracted moving, set-up and installation procedures if arrangements have been made to use this procedure. The employer shall ensure that all employees working with equipment are fully trained in safe working procedures and in any required special work practices.
