Title 40.1-51.1,(A), Code of Virginia:  The employer did not
furnish employment and a place of employment which was free from
recognized hazards that were likely to cause death or serious
physical harm in that:
(a) Two (2) employees of Princess Anne Construction Co.,Inc. were
observed riding a backhoe at one time, located at Old Dominion
University East 45th Street. The manufacturer of the backhoe
provides one seat to safely accommodate one person, the driver.
One feasible and acceptable method to correct this hazard is to
adhere to the Safety Standards for Construction Industry, part
1926.601(b)(8): Vehicles used to transport employees shall have
seats firmly secured and adequate for the number of employees to be
carried.
