Title 40.1-51.1(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that 22 employees were riding on a flatbed trailer when the trailer became detached from the tractor on a steep decline and rolled downhill and into a stand of trees coming to rest on top of one employee. REF: ANSI Z133.1-1988 American National Standard for Tree Care Operations. One feasible and acceptable abatement method, among others, to correct this hazard is to provide a method of transportation that is suitable for employees.

Title 40.1-51.1(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not assure equipment being used by employees was operating within the manufacturer's limitations as described in the manufacturer's operating instructions. A John Deere 5400 tractor was being used to pull a 16 foot flatbed trailer down an approximate 30 degree slope loaded with 22 employees and 1 ton of gypsum. The tractor lost control of the load and jackknifed. The trailer became detached from the hitch and rolled downhill, crashing into a stand of trees resulting in six (6) employees being injured. REF: ANSI Z133.1-1988 American National Standard for Tree Care Operations. One feasible and acceptable abatement method, among others, to correct this hazard is to maintain and follow manufacturer's operating instructions.
