40.1-51.1.(A): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of operating moving equipment, such as the tractor-type fertilizer loader, where they could drive over the unprotected edge of the warehouse ramp, and where the equipment was not equipped with a roll-over protective system (ROPS) or a seat belt to restrain the operator on the moving equipment. One feasible and acceptable abatement method, among others, to correct this hazard is to replace the curbs or coamings on the sides of the warehouse equipment ramp.
