Title 40.1-51.1.(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: In the yard, the seatbelts installed on the Nissan 9000 (NSN found) and the Hyster (Co.# 6) powered industrial trucks, being used in material handling operations, were not worn by the operators. "One feasible and acceptable abatement method, among others, to correct this hazard is to require powered industrial truck operators to wear seatbelts when the truck is equipped with them."ed
